1. About these terms

These terms of service ("Terms") govern your use of the website building platform ("Platform") operated by Senhuo Ltd (trading as Senhuo Digital), a company registered in England and Wales ("we", "us", "our").

By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Platform. Your continued use after notification constitutes acceptance of the updated Terms. If a change requires re-acceptance under law, we will ask you to explicitly accept before you can continue using the Platform.

2. What the Platform does

The Platform is a website generation service for small businesses in the United Kingdom. We build, host, and maintain a website on your behalf based on information you provide through our surveys and communications.

The Platform is not a content management system, marketplace, or general website builder. We generate and manage your website for you.

If you proceed to purchase our services, a separate Platform Service Agreement will govern the terms of that engagement, including fees, service scope, and cancellation.

3. Eligibility

To use the Platform, you must be at least 18 years old, be legally capable of entering into a binding contract, be a resident of or operating a business in the United Kingdom, and provide accurate and complete information during registration and surveys.

Business accounts must be registered by someone authorised to act on behalf of the business. We do not knowingly collect data from anyone under 18.

4. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately at hello@senhuo.co.uk if you suspect unauthorised access.

We may suspend or terminate your account if you breach these Terms, provide false or misleading information, or use the Platform for unlawful purposes.

5. Your content and data

"Your Content" means the business information, text, images, logos, and other materials you provide to us through surveys, uploads, or communications.

You retain ownership of Your Content. By submitting it, you grant us a non-exclusive, worldwide licence to use, store, display, and modify Your Content solely for the purpose of providing the Platform's services to you.

You represent that Your Content does not infringe any third party's intellectual property rights, is accurate and not misleading, and complies with all applicable UK laws.

We may use AI tools to generate website content (headlines, descriptions, page copy) based on Your Content. The AI-generated content is derived from the facts you provide — we do not invent business information such as prices, qualifications, addresses, opening hours, or reviews.

6. Our content and intellectual property

The Platform, its code, design templates, components, and underlying technology (including designs generated via third-party tools) are owned by us or our licensors. Creating an account does not transfer ownership of any Platform intellectual property to you.

7. Account deletion

You may request deletion of your account at any time from your dashboard or by emailing hello@senhuo.co.uk. Deletion follows a two-phase process: you have a 30-day grace window to restore your account, after which we scrub personal data from our live systems. Full database-level purge happens by day 90 from your original request. Data we are required to retain by law (e.g. tax records retained by Stripe for HMRC) is unaffected.

If you have an active service subscription, account deletion will also cancel your subscription. The terms of that cancellation are governed by your Platform Service Agreement.

8. Acceptable use

You must not use the Platform to conduct any unlawful activity, infringe any third party's rights, distribute malware or harmful code, send unsolicited communications (spam), impersonate any person or entity, attempt to gain unauthorised access to the Platform or other users' data, or submit content that is defamatory, obscene, discriminatory, or otherwise unlawful.

We reserve the right to remove content or suspend accounts that violate this policy.

9. Data protection and cookies

We process personal data in accordance with our Privacy Policy and UK GDPR. By creating an account, you acknowledge that we collect and process the personal data described in our Privacy Policy.

Our use of cookies is described in our Privacy Policy. We use only essential cookies required for the Platform to function.

10. Limitation of liability

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of profits, revenue, data, or business opportunities.

If you become a paying customer, the liability terms in your Platform Service Agreement apply instead of this section.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, any breach of our data protection obligations under UK GDPR, or any liability that cannot be excluded or limited by law.

11. Suspension and termination

We may suspend or terminate your account immediately if you materially breach these Terms, if we are required to do so by law or a regulatory authority, or if your use poses a security risk to the Platform or other users.

Where reasonably possible, we will give you notice before taking action and an opportunity to remedy the issue.

12. Dispute resolution

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days.

13. Changes to the Platform

We may modify, update, or discontinue features of the Platform at any time. If we make changes that materially affect your use, we will provide reasonable notice.

14. Force majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, acts of government, pandemic, internet or telecommunications failures, or third-party service provider outages.

15. General

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding use of the Platform (excluding any paid services, which are governed by a separate Platform Service Agreement). No third party has any rights under these Terms under the Contracts (Rights of Third Parties) Act 1999.
